Lesson 3: Failed the Exam — What Now? Retake Rules & Advice
Scoring rules for the theory exam (FeV Annex 7: max. 10 penalty points, two wrong 5-point questions = failed), statutory retake period (FeV § 18: generally at least two weeks — not the often-cited '7-day rule'), deadlines, and strategy for your second attempt.
1. How the Theory Exam Is Scored (FeV Annex 7 No. 1.2.2 and 1.2.3)
- 30 questions (20 basic general material + 10 Class B supplementary material) with a total value of 110 points.
- Failed is the result if more than 10 penalty points are accrued or if two 5-point questions are answered incorrectly — even if total penalty points do not exceed 10.
- A failed theoretical exam must be retaken in its entirety (Annex 7 No. 1.2.3) — previous partial successes do not count.
2. The Retake Period — Please Do Not Call It the "7-Day Rule"
The law defines the exact same rule for both exams (theory and practical) in FeV § 18 para. 1 sentence 2:
"A failed exam may not be repeated before the expiry of a reasonable period, usually at least two weeks."
- The popular "7-day rule" for theory tests is not in the statutory text — it is an informal guideline from testing practice. Rely on your driving school for current appointment rules; legally you are only guaranteed the right to retest after two weeks following a failed attempt.
- The practical test can likewise only be retaken after this reasonable period; parts of the exam already passed (e.g. theory) do not need to be repeated (FeV Annex 7 No. 2.5.1).

3. Is There a Limit on Retake Attempts?
- There is no legal limit on the number of retakes in the FeV. However, time limits act as practical boundaries: a passed theory exam is valid for only 12 months (FeV § 18 para. 2), and training must not be older than 2 years (FeV § 16 para. 3).
- Attempted cheating: The exam is graded as failed; retaking can be barred for up to nine months (FeV § 18 para. 1) — phones, cheat notes, or unauthorized aids have zero place in the exam room.
4. Strategy for Your Second Attempt
- Analyze mistakes constructively: Review your score sheet. Did you fail on two 5-point questions? Target high-weight topics specifically (priority / Vorfahrt, following distance, speed limits).
- Simulate tests rather than relying on luck: Practice with our free exam simulation in authentic format — 30 questions, 45 minutes, scoring with penalty points including the 2×5-point rule. If you pass three consecutive simulations with under 6 penalty points, you are test-ready.
- Stay calm before the exam: In the week leading up to the retest, study in short morning bursts rather than exhausting night shifts. Getting good sleep before exam day is the most underrated learning strategy.
- For the practical exam: A single minor mistake does not fail you — repeated errors or serious safety breaches do (FeV Annex 7 No. 2.5.2). Details in the course "Class B Practical Driving Exam".
